General Terms and Conditions (GTC) of Greenwick GmbH
1. scope of application
1.1 These GTC apply to all contracts for the delivery of goods that a customer concludes with Greenwick GmbH (hereinafter "Seller") with regard to the goods presented in the Seller's online shop. Conflicting or deviating terms and conditions of the customer shall not be recognised unless otherwise agreed.
1.2 These GTC apply accordingly to contracts for the delivery of vouchers, unless otherwise agreed.
1.3 A "consumer" within the meaning of these GTC is any natural person who concludes a legal transaction for non-commercial purposes.
1.4 An "entrepreneur" within the meaning of these GTC is a natural or legal person or a partnership with legal capacity that is acting in the exercise of its commercial or independent professional activity when concluding a legal transaction.
1.5 Depending on the seller's product description, the subject matter of the contract may be both the purchase of goods by way of a one-off delivery and the purchase of goods under a subscription contract, under which the seller undertakes to deliver the agreed goods to the customer at the agreed intervals.
2. conclusion of contract
2.1 The product descriptions in the seller's online shop do not constitute binding offers, but serve the submission of a binding offer by the customer.
2.2 The customer submits his offer via the integrated online order form. By clicking the order button, the customer submits a legally binding contractual offer.
2.3 The seller can accept the customer's offer within five days by sending a written order confirmation or by delivering the goods or requesting payment. The contract is concluded when one of these alternatives occurs.
2.4 If the payment method PayPal or Amazon Payments is selected, the offer is accepted by the seller as soon as the customer clicks the order button.
2.5 The text of the contract is saved by the seller and sent to the customer in text form.
3. right of cancellation
3.1 Consumers have a right of cancellation.
3.2 Details of the right of cancellation can be found in the seller's cancellation policy.
3.3 The right of cancellation does not apply to consumers outside the EU.
4. prices and terms of payment
4.1 The prices quoted are total prices including statutory VAT.
4.2 For deliveries outside the EU, additional costs may be incurred which are to be borne by the customer.
4.3 The payment options are communicated in the seller's online shop.
4.4 In the case of advance payment, payment is due immediately.
4.5 If PayPal or SOFORT is used, payment is made immediately.
5 Delivery and shipping conditions
5.1 Delivery is made to the specified delivery address.
5.2 Costs for failed deliveries shall be borne by the customer, unless he exercises his right of cancellation.
5.3 The shipping risk shall be borne by the customer, unless the customer is acting as a consumer.
5.4 The customer will be informed immediately if the goods are not available.
6 Contract duration and cancellation of subscription contracts
6.1 Subscription contracts are open-ended and can be cancelled at any time without notice.
6.2 Extraordinary cancellation is possible if there is good cause.
6.3 Cancellations are possible in writing or by e-mail.
7. retention of title The seller retains ownership of the delivered goods until full payment has been made.
8. liability for defects (warranty)
8.1 The statutory provisions on liability for defects apply.
8.2 For entrepreneurs, different regulations apply to the limitation period and liability for new or used goods.
8.3 The limitations of liability do not apply to claims for damages by the customer, fraudulently concealed defects, construction defects or digital products.
9. redemption of promotional vouchers
9.1 Promotional vouchers can be redeemed in the online shop during the specified period.
9.2 Only consumers can use promotional vouchers.
9.3 Individual products may be excluded from the promotion.
9.4 Promotional vouchers can only be redeemed before completing the order process.
9.5 Only one promotional voucher can be used per order.
9.6 The remaining credit will not be refunded.
9.7 If there is insufficient credit, the difference can be paid elsewhere.
10. redemption of gift vouchers
10.1 Gift vouchers can be redeemed in the online shop.
10.2 Gift vouchers can be redeemed until the end of the third year after purchase.
10.3 Subsequent offsetting is not possible.
10.4 Only one gift voucher can be used per order.
10.5 Gift vouchers can only be used for goods.
10.6 Remaining credit will be credited until the expiry date.
10.7 The remaining credit will not be paid out.
10.8 Gift vouchers are transferable.
12. alternative dispute resolution The seller does not participate in dispute resolution proceedings before a consumer arbitration board.
